The Ace Alliance finds this Governance Action to be constitutional. Our review concerns the constitutionality of the Info Action, which is a poll of the DReps, not the merits of the Cardano Product Committee’s draft “Cardano 2030 Vision & Strategy” document. Constitutional Committee members may not prevent Info Actions from being recorded on chain but they are allowed to express their views on whether the actions proposed within an Info Action would be constitutional if implemented by on-chain mechanisms (Article VII, Section 4).
This poll of the DReps was submitted by an anonymous community member, not the Cardano Product Committee of Intersect who are authoring the “Vision & Strategy” document in question. It requests DReps to express opinions on a version of the Cardano Product Committee’s draft plan. Because Cardano is a decentralized ecosystem, any community participant may post such a poll to gauge sentiment in this way. We also note that the referenced document may have changed between the time this Info Action was submitted and the current version of the Cardano Product Committee’s materials. However, this evolution does not affect the constitutionality of the action, since Info Actions may reference ongoing or partial work without violating constitutional principles.Due to its adherence to constitutional provisions under Article VII of the Cardano Constitution, this Info Action is Constitutional.

The document is too ambiguous in its intent. It is half-way between a constitution and a budget proposal. Yet it is neither. Approving this document could help it being later weaponized to justify budgets and/or actions that do not go through due diligence.

The "Cardano 2030: Our Future, Defined" document is framed very much like a constitution, yet it is not presented as such. It overlaps with the constitution in many aspects; yet it does not undergo the same level of approval as a constitution amendment. In this, it violates Article VIII Section 2.
Second, it could also be interpreted as laying the foundation of a budget proposal. Which is also dangerous as it then becomes a vehicle for fast-tracking under-specified budgets and poorly justified withdrawal requests on the sole basis that they are aligned with the Cardano 2030 vision.
The lack of author (and accountability thereof) on the document adds also to the ambiguity and uncertainty around it. While the document is an interesting take coming straight from the Intersect Product Committee, it has been seemingly proposed without prior agreement with the Product Committee.

We have determined that this Info action does not meet the criteria deemed necessary for the Constitutional Committee to assess its constitutionality.
Article VII, Section 1 of the Cardano Constitution states "The Constitutional Committee shall comprise a set of owners of ada that is collectively responsible for ensuring that on-chain governance actions prior to enactment on-chain, are constitutional."
Additionally; Article VII, Section 4, Paragraph 2 states "Because "Info" actions have no on-chain effect and, accordingly, are neither constitutional nor unconstitutional, Constitutional Committee members may not prevent "Info" actions from being recorded on-chain. Members of the Constitutional Committee may nevertheless record a vote on-chain regarding an "Info" action in order to express their view on such "Info" action, including whether the suggested course of action proposed in such "Info" action, would be, in the view of such member, unconstitutional if it were to be enforced by on-chain mechanisms."
Finally; Article VII, Section 4, Paragraph 3 states "In the case of “Info” actions that propose a Cardano Blockchain ecosystem budget, Constitutional Committee members shall record a vote on-chain that sets forth their opinion as to whether the proposed budget, if it were to be implemented in the form contained in the "Info" action, would violate this Constitution."
The governance action with ID "gov_action1n9h...m57age" and title "Defining the Cardano 2030 Vision & Strategy", as an Info governance action, does not relate to a budget proposal, nor does it gauge sentiment towards another type of governance action which could be enacted on-chain, so the Constitutional Committee is not empowered to assess its constitutionality, ensuring DReps and SPOs are the only ones able to influence its outcome.

Tingvard abstain from judging the “Defining the Cardano 2030 Vision & Strategy” Info action.
This proposal is properly framed as an Info action under Article III, § 4. Info actions are designed to gauge community sentiment and record non-binding signals without enacting any change to the protocol or governance framework. As such, they are not themselves constitutional or unconstitutional under Article VII, § 4.
The action invites DReps to signal their support for, or opposition to, a proposed long-term vision and strategy for Cardano.
