    I am voting yes because this governance action is fundamentally about honoring the outcome of Cardano’s 2026 Constitutional Committee election and ensuring continuity of constitutional governance.

    The four incoming members — Philip DiSarro, Leandros BSP, Marek Mahut, and Cardano Curia — were selected through the established public election process, with candidate registration, stake-weighted DRep voting, independent auditing, and publication of the final results before this update action was submitted. Approving this action therefore respects the legitimacy of that process rather than reopening the candidate selection after the election has already concluded.

    I also believe continuity matters. The Constitutional Committee plays a necessary role in reviewing governance actions for constitutional compliance, and the expiring seats must be renewed to keep the committee functioning properly. This update balances continuity through the re-election of existing members with new representation through incoming members, while preserving the existing quorum and established term limits.

    For me, the key principle is simple: if Cardano establishes a transparent, auditable election process, then governance should faithfully enact its results unless there is a material procedural or constitutional defect.     This governance action updates the four Constitutional Committee seats whose terms expire at Epoch 653 by appointing the candidates elected through the 2026 Constitutional Committee election.     Positive aspects

    The electoral process for renewing the Constitutional Committee followed a previously defined methodology, included public voting, and its results were audited. The existence of a public election, a verifiable process, and an independent audit of the results has value.

    Participation in the election was very low for a decision of this importance. The four elected candidates received between 23 and 28 DRep votes. Still, the problem cannot be evaluated only by the volume of ADA. Cardano has DReps with extremely large amounts of voting power, meaning that a small number of participants can represent a very large share of stake. Legitimacy in this type of election needs to consider both voting power and diversity of participation.

    This is especially evident in the cases of Marek Mahut and Cardano Curia. Considering the total participating voting power reported for the election, they were elected with approximately 59% and 55% of the participating voting power, respectively. At the same time, they received only 28 and 27 DRep votes. These numbers are not particularly robust for conferring an institutional mandate of this relevance.

    The existence of an off-chain election does not remove the responsibility of DReps to subsequently evaluate the composition submitted through the Governance Action. The on-chain vote should not be treated merely as a formality intended to automatically ratify the previous result. The occurrence of an election does not create an obligation to support candidates who are not regarded as suitable for the Constitutional Committee.

    There are particularly relevant concerns regarding Philip DiSarro. Over time, a negative evaluation of his track record in the ecosystem has been formed.     Other people may evaluate Philip or any other candidate differently. These evaluations inevitably contain an element of individual judgment. Other DReps have already expressed concerns about specific members elected to this composition, and doing so is entirely legitimate. An election does not automatically transform every elected candidate into someone each individual DRep must regard as suitable for the position.

    Risks and concerns

    Institutional independence is the most important concern regarding the composition. It is not healthy for members of a body whose function is to conduct constitutional assessments to be simultaneously distributed across several other structures of power, funding, oversight, or decision-making within the ecosystem. The greater the overlap of roles, the greater the risk of conflicts of interest and the weaker the perception of neutrality of the Constitutional Committee.

    Months ago, Philip was observed acting and voting simultaneously in another governance role and as a member of the Constitutional Committee, alternating between these functions in different situations. The issue appeared sufficiently problematic for a public poll to be opened asking the community how this type of behavior should be viewed. The predominant perception among the responses and interactions received was opposed to the simultaneous exercise of these roles.

    It is not necessary to demonstrate that a particular conflict effectively altered a decision. A constitutional body needs to preserve not only its material independence but also a reasonable perception of independence. Accumulating functions across different layers of governance, especially when these activities may eventually intersect, weakens that perception.

    This one's straightforward for me. The election was public, it was audited, everything's on-chain and checkable. Two of the four people are already on the committee doing the work, and the other two bring something new without anyone grabbing extra power.

    The committee needs to be full to function, and this fills it the right way. I don't see anything here that gives me pause.
